These terms apply when you use Smile File ("we", "us"). By creating a Smile File or adding a message to one, you agree to these terms.
What Smile File does
Smile File lets you build a digital card, collect messages and photos from others, and optionally collect money toward a shared gift. You share the card through a private link.
Your account
You sign in with your email address using a one-time link. You are responsible for keeping access to your email secure and for activity on your account.
Payment
Creating a Smile File and collecting messages is free. Some features require a one-off payment of A$12, shown to you before you pay. Payments are processed by Stripe. Because a Smile File is made available to you immediately, payments are generally non-refundable, except where required by Australian Consumer Law. If something goes wrong, email us and we will make it right.
Content you add
You keep ownership of the photos, messages, and other content you add. By adding content, you give us permission to host and display it as part of the Smile File. You are responsible for the content you add, and you agree not to upload anything that is unlawful, infringing, hateful, or that you do not have the right to share.
If you add photos or videos of other people, you confirm you have their permission to include their image. People have rights over the use of their own likeness, so only upload images of someone else when you have their consent, or, for a child, the consent of their parent or guardian. If someone asks to have an image of themselves removed, let us know and we will take it down.
Smile File is for your own photos and material, or content you otherwise have the right to use. Please do not upload images, artwork, logos, characters, or other material taken from the internet or belonging to someone else, including brand, product, or celebrity images, unless you hold the rights or a licence to use them. Tools we provide, such as removing the background from a photo, are meant for your own images. You are solely responsible for everything you add, and you agree to indemnify us against any claim, loss, or cost arising from content you upload that infringes someone else's rights or breaks these terms. If we receive a complaint about content, we may remove it.
Acceptable use
Please do not misuse Smile File - for example by trying to break its security, access Smile Files you were not given a link to, or use it to harass others. We may suspend or remove content or accounts that break these terms.
Shared gift money
Where a Smile File collects money toward a gift, those contributions are handled through the payment details set up by the card's creator. We are not responsible for how a creator uses money collected for a gift.
Availability
We work hard to keep Smile File running, but we provide it "as is" and cannot guarantee it will always be available or error-free. To the extent permitted by law, we are not liable for any loss arising from your use of the service. Nothing in these terms limits rights you have under the Australian Consumer Law.
Changes
We may update these terms from time to time. We will change the "last updated" date above when we do.
